desktop wakes up locked

after double tap waking from lock-screen, whether stock or Next 2.5.1 that I use, the desktop is usually locked to touch or nav until I touch the Home button.
any ideas on a fix?
Been the issue since rooted and unlocked, no matter what ROM.
